In exercise of the powers conferred by Sees. 4 and 7 of the Indian Telegraph Act, 1885 (13 of 1885) and Sees. 4 and 10 of the Indian Wireless Telegraphy Act, 1933 (17 of 1933) and in supersession of "the use of Wireless LAN (W-LAN) and Bluetooth and IEEE 802.IIb Technology Equipment in 2.4 GHz band Exemption Rules, 2002", the Central Government hereby makes the following rules, namely : 1. Short title and commencement :- (1) These rules may be called the Indoor use of Wireless LAN (W- LAN) Equipment using Bluetooth and IEEE802.11b Standard in 2.4 GHz band (Exemption from Licensing Requirement) Rules, 2003. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definition :- In these rules, unless the context otherwise requires, (a) "Act" means the Indian Telegraph Act, 1885 (13 of 1885) and the Indian Wireless Telegraphy Act, 1933 (17 of 1933); (b) "Wireless LAN" means a wireless local area network (LAN) a flexible data communication system implemented as an extension to or an alternate for a wired LAN using radio frequency (RF) technology. Wireless LAN transmit/receive data over the air and minimizing the need for wired connections; (c) "Bluetooth and IEEE 802.11b Standard" means short range wireless communication standards which are used for transmitting information between terminals and also include a wireless LAN; (d) "Spread spectrum technology" means a wideband radio frequency technology. 3. Use of Wireless LAN using Bluetooth and IEEE802.11b Standard :- Notwithstanding anything contained in any law for the time being in force, no licence shall be required by any person to establish, maintain, work possess or deal in Wireless LAN with Bluetooth and IEEE 802.lib standard equipment using spread spectrum technology for his own usage subject to such frequency band of operation, power, EIRP, type of antenna, mode of operation and coverage area as specified in the Table below; namely : 4. Interference :- The effect of unwanted energy due to one or a combination of emissions, radiations or induction upon reception in a radio communication system, mani- fested by any performance degradation misinterpretation, or loss of information which could be extracted in the absence of such unwanted energy. In case where any person to whom a licence has been issued under Sec. 4 of the Act (ITA, 1885) informs that his licensed system is getting harmful interference from any other radio communication system exempted under these rules, the indoor use of such Wireless LAN equipment using Bluetooth and IEEE802.11b standard shall be discontinued. 5. Equipment :- (a) The Wireless LAN equipment using Bluetooth and IEEE802.11b Standard be type approved and designed and constructed in such a manner as to ensure that the bandwidth of emission shall conform to the frequency limits specified in the table referred to in Rule 3 above. (b) The application for obtaining Equipment Type Approval shall be made to the Central Government in such Form as may be specified by it in this behalf.
