Method of packing SCHEDULE 1 :- SCHEDULE 1 SCHEDULE 2 :- SCHEDULE 2 ISUBGOL HUSK (GRADING and marking) RULE, 1982 Whereas a draft of the Isubgol Husk (Grading and Marking) Rules, 1981, was published as required by Sec. 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), on pages 903 to 906 of the Gazette of India, Part-II Section-3 Sub-section (i), dated the 4th April, 1981, under the notification of the Government of India in the Ministry of Rural Reconstruction, No G.S.R. 355, dated the 17th March, 1981, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty days from the date on which the copies of the Gazette of India containing the said notification were made available to the public; All whereas the copies of the said Gazette were made available to the public on the 27th, April, 1981; And whereas no comments and suggestions have been received from the public in respect of the said draft by the Central Government; Now, therefore, in exercise of the powers conferred by Section 3 of the said Act, the Central Government hereby makes the following rules, namely: 1. Start title, application and commencement :- (1) These rules may be called the Isubgol Husk (Grading and Marking) Rules, 1982. (2) They shall apply to Isubgol Husk prepared from psyllium seeds produced in India. (3) They shall come into force on the date of their publication in the official Gazette. 2. Definitions :- In these rules, unless the context otherwise requires, - (a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (b) "Authorise Packer" means a person or a body of persons who has been granted a Certificate of Authorisation by the Agricultural Marketing Adviser for getting the commodity graded and marked in accordance with the grade standards and procedures prescribed under the rules; (c) "Certificate" means Certificate of Authorisation; (d) "Schedule" means a Schedule appended to these rules. 3. Grade designations :- The grade designation to indicate the quality of lsubgol Husk shall be as set out in column 1 of Schedule I. 4. Definition of quality :- The quality of Isubgol Hask shall be as set out against each grade designation in columns 2 to 7 of Schedule I. 5. Grade designation marks :- The grade designation mark shall consist of either- (i) a design incorporating the number of the Certificate, the word "Agmark" and the grade approved by the Agricultural Marketing Adviser, as set out in Schedule II; or (ii) a label specifying the grade approved by the Agricultural Marketing Adviser and bearing the design consisting of an outline map of India with the word "AGMARK" and the figure of the rising sun with the words "Produce of India" and resembling the one as set out in Schedule II. 6. Method of marking :- (1) The grade designation mark shall be securely affixed to or printed on each container in a manner approved by the Agricultural Marketing Adviser. (2) The following particulars shall also be clearly and indelibly marked on each container, namely:- (a) Date of packing, (b) Net weight, (c) Place of packing, and (d) Name of the packer. (3) An authorised packer may, after obtaining the prior approval of the Agricultural Marketing Adviser, mark his private trade mark on a container in a manner approved by the said Adviser: Provided that the private trade mark shall not represent a quality of grade different from that indicated by the grade designation mark affixed to the container in accordance with these rules. 7. Method of packing :- (1) Isubgol Husk shall be packed either in new single gunny bags with polythene lining, or in new double gunny bags with or without polythene lining or incloth bags with polythene lining, or in polythene bags or in polythene laminated paper pouches, or in ploythene lined cardboard cartons, or in glass bottles, or in such other manner as may be approved by the Agricultural Marketing Adviser. (2) The containers shall be securely closed and sealed in a manner approved by the Agricultural Marketing Adviser. (3) Each container shall contain Isubgol Husk of one grade only.
