1. The present writ petition has been filed under Article 226 of the Constitution of India with the following prayers:-
“(I). Issue an appropriate writ, order or direction in the nature of mandamus quashing the letter dated 25.11.2023(Annexure No. 6) & letter dated
08/12/2023(Annexure No. 7) & letter dated 02/01/2024, (Annexure No. 8) and further directing the Respondent no 1 to 3 to accept the resignation
letter and to relieve the petitioner from the post of Assistant Professor, Department of Anatomy, Veer Chandra Singh Garhwali Institute of Medical
Science & Research, Srinagar, Pauri Garhwal.
(II). Issue an appropriate writ, order or direction in the nature of mandamus directing the respondent no 4, to transfer of Aadhar Enabled Biometric
System (AEBAS ID) from the previous organization to the current organization i.e Graphic Era Institute of Medical Sciences.
(III). Issue any suitable writ, order or direction, which this Hon'ble Court may deem fit and proper on the basis of the facts and circumstances of the
case.â€
2. Heard Mr. Rohit Dhyani, learned counsel for the petitioner and Mr. P.C. Bisht, learned Addl. C.S.C. for the State.
3. Mr. Rohit Dhyani, Advocate, has requested to decide the present writ petition directing the Competent Authority to accept the resignation letter of
the petitioner. He further submitted that the petitioner will submit her fresh resignation letter before the Competent Authority within ten days’ from
today.
4. Mr. P.C. Bisht, learned Addl. C.S.C. for the State seeks three weeks’ time to decide the petitioner’s resignation letter.
5. Having heard the learned counsel for the parties, the present writ petition is disposed of by directing the Competent Authority that if the petitioner
submits her resignation letter before him within ten days’ from today, then he will take a decision on her resignation letter by a speaking order,
expeditiously, preferably within a period of three weeks from the day of submission of the resignation letter.
6. Needless to say that the Competent Authority shall consider the petitioner’s resignation letter in accordance with the relevant rules.
7. It is also clarified here that this Court has not expressed any opinion on the merits of the case.
