The petitioner submits that she was engaged as Helper/Aaya in Primary School, Mithi Dhara. On 03.08.2023, respondent No.3 issued an order of
disengagement of the petitioner on the ground that she was engaged without following due procedure. The said order of disengagement was
challenged by the petitioner in WP(C) No.2046/2023. This Court, while issuing notice to the other side in the aforesaid writ petition, stayed the
impugned order of disengagement of the petitioner.
The grievance of the petitioner is that after stay of the impugned order of disengagement, the petitioner has been continuing, but she has not been paid
the salary. Ordinarily, an application should have been moved in WP(C) No. 2046/2023, however, having regard to the nature of relief prayed for, this
petition can be disposed of at this stage without issuing notice to the respondents keeping in view the innocuous prayer made in it.
Accordingly, this petition is disposed of with a direction to respondent No.2 to release the wages of the petitioner for the period she has performed her
duties and shall also be paid the wages in future, provided there is no legal impediment.
