1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.
3. The petitioner is in custody in connection with P.S. Case No. 45 of 2022 corresponding to T.R. Case No. 54 of 2022 pending in the Court of the
learned Additional Session Judge-cum-Special Judge, Gunupur for the alleged commission of offence under Sections 20(b)(ii)(C)/25/27(A)/29 of
NDPS Act.
4. It is submitted that out of 21 chargesheet witnesses, only 3 have been examined so far. The total period of detention of the petitioner is more than
two years though he has been granted an interim bail by this Court on two occasions, he has surrendered to custody in time on both occasions without
misusing his liberty.
5. Taking note of the apparent delay in conclusion of the trial, I am inclined to take a lenient view, the bail application is disposed of directing the court
below to release the petitioner on interim bail for a period of two weeks from the date of his actual release on such terms and conditions as may be
fixed by the Court in seisin over the matter.
6. After expiry of the aforesaid period of two weeks, the petitioner shall surrender before the Court in seisin over the matter, failing which appropriate
warrant may be issued for his production.
7. The BLAPL is accordingly disposed of.
8. Urgent certified copy of this order be granted on proper application.
