1. The petitioner was issued a loan of Rupees Fifteen Lakh, by the respondent / Bank for opening and running a poultry farm in Tehsil Garud, District

-Bageshwar. Due to certain unavoidable circumstances, the installment of the loan could not have been paid by the petitioner, which resulted into his

account having been converted into NPA.

2. The Bank proceeded further to recovery of the loan, but for one reason and another, the petitioner failed to repay the loan, and finally a recovery

citation was issued on 18.10.2024, by the respondent no. 2, for recovery of the amount of Rs. 2704199/ - from the petitioner.

3. Without going into the merits of the case, learned counsel for the petitioner submits that the petitioner is ready to make the payment of the amount

outstanding against him with interest up to date, but for that purpose he needs certain time. He further submitted that two years period would be

suffice to make the repayment of the aforesaid amount. This proposal is also accept able to the respondent bank.

4. Accordingly, the writ petition is disposed of in the following terms: -

“1. Petitioner shall deposit a sum of Rupees Seven Lakh, within a period of one month from today i.e. on or before 04.01.2025, to the bank to show

his credentials and if he deposits a sum of Rupees Seven Lakh, within the aforesaid period, the rest of the amount of Rs. 2004199/ - would be paid by

the petitioner in twenty equal monthly installments. The last installment would carry the entire interest accrued thereon.

2. If the petitioner fails to comply in any of the terms and conditions pointed out in the order, the bank would be free to recover the entire amount from

the petitioner.â€​
