1. Applicant is in judicial custody in Case Crime No.316 of 2023, under Section 354 IPC and Sections 9 and 10 of the Protection of Children from

Sexual Offences Act, 2012, Police Station Khatima, District Udham Singh Nagar. He has sought short term bail on the ground of illness of his

daughter.

2. Heard learned counsel for the parties and perused the record.

3. Learned counsel for the applicant would submit that the eldest daughter of the applicant, who is 18 years of age, is prone to epilepsy; she is mentally

retarded; quite often, she is to be taken to hospital. The applicant wants to get her examined. Therefore, the applicant may be granted short term bail.

4. Learned State Counsel, under instructions, admits all these facts. It is stated by learned State Counsel that at present, the eldest daughter of the

applicant is under treatment in a hospital at Bareilly.

5. Without adverting further on any aspect of the matter, purely on the humanitarian ground, this Court is of the view that, the applicant may be

granted short term bail for a period of two weeks from the date of his release.

6. Short term bail application is allowed.

7. Accordingly, the applicant shall be enlarged on short term bail only for a period of two weeks from the date of his release on his executing a

personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned. It is further directed that, on

expiry of two weeks, the applicant shall surrender before the court concerned and intimation to this effect shall also be given to this Court.
