1. This intra court appeal is directed against the order passed in the writ petition by which the appellant sought for accepting his bid pursuant to a

tender invited by notice dated 9.8.2024.

2. The appellant alleges that a bunch of hooligans prevented the appellant from entering the office of the Gram Panchayat forÂ

executing the agreement.

3. On an earlier occasion this court had directed the Block Development Officer to enquire into the matter pursuant to which a report has been filed

dated 10th December, 2024 wherein it is stated that the allegations made by the appellant that he was restrained from entering into

the office of the Gram Panchayat is baseless.

4. However, it is noted that the notice inviting tender was cancelled by the Committee on behalf of the Gram Panchayat and fresh notice inviting

tender dated 3.10.2024 was issued.

5. The learned Single Bench has noted that the petitioner has not challenged the cancellation of the earlier tender.

6. In any event, merely because the petitioner was the lowest tenderer that would not give any indefensible right to the appellant/petitioner to state that

the tender has to be executed in his favour.

7. Thus, we find no ground to interfere with the impugned order.

8. Accordingly, the appeal stands dismissed.
