1. This writ petition has been filed by the petitioner under Article 227 of the Constitution of India.

2. By means of this writ petition, petitioner wants to expedite Suit No.49 of 2010 (New No.17/2020-21), Shri Tikaram Singh Vs. Shri Bhagwan Singh

and others, under Section 176(2A) of U.P.Z.A. and L.R. Act, 1950, pending in the court of learned Assistant Collector Ist Class, Dehradun.

3. It is case of the petitioner that the aforesaid original suit was filed in the year 2010. The respondent no.1 to 5 file his objection against the

preliminary decree passed on 12.04.2016 in Suit No.49 of 2010 on 13.07.2016 as to amend the preliminary decree.

4. The petitioner is 72 years of age and the suit is pending since 2010. He wants to reap the benefits of litigation during his life time. In this view of the

matter, such a direction can be issued to the trial court to decide the said suit expeditiously.

5. In this view of the matter, the writ petition is partly allowed. Learned Assistant Collector Ist Class, Dehradun is directed to decide Suit No.49 of

2010 (New No.17/2020-21), Shri Tikaram Singh Vs. Shri Bhagwan Singh and other, under Section 176(2A) of U.P.Z.A. and L.R. Act, 1950,

expeditiously within a period of six months from the date of production of certified copy of this order.
