1. The present Regular Bail Application under Sect ion 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed in connect ion w it h the

Case Crime No. 525 of 2024, registered at Kotwali Roorkee, District Haridwar under Sections 112, 317(2) and Section 3(5) of the Bharatiya Nyaya

Sanhita, 2023.

2. The applicant and a co-accused snatched a golden chain of the inform ant on 08.08.2024 and ran away. They sold the said chain. Rs.10,000/ -

(Rupees Ten Thousand) each were recovered from their possession.

3. Heard Mr. Tapan Singh, learned counsel for applicant and Mrs. Manisha Rana Singh, learned Deputy Advocate General for respondent.

4. Mr. Tapan Singh, Advocate, has contended that the applicant has been falsely implicated in the present matter. The co-accused of the similar role

has been released on bail by the Magistrate. Applicant is not a previous convict. He is a perm anent resident of District Saharanpur, therefore, there is

no likelihood of his absconding, and, he is in custody since 19.09.2024.

5. Mrs. Manisha Rana Singh, learned Deputy Advocate General has opposed the bail application orally.

6. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any

opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.

7. The Bail Application is allowed.

8. Let the applicant â€" Shubham Mishra be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like

amount, to the satisfaction of the court concerned.
