Heard learned counsel for the petitioner and Sri Rajesh Kumar Pathak, learned counsel for the opposite parties.

All the opposite parties are granted four weeks'' time for filing counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

List this case after expiry of the aforesaid period alongwith the record of Writ Petition No.7819 (SS) of 2008.

Learned counsel for the petitioner submits that till date, the opposite parties have not amended Regulation 31 of 1978 Regulations and the petitioner has a right to continue upto the age of 60 years.

In view of the aforesaid facts, it is provided as an interim measure that the petitioner shall continue in service till he attains the age of 60 years or till further orders of this Court, whichever is earlier.
