Heard learned counsel for the parties.
The petitioner claims that he is entitled for getting benefit from the date of his initial appointment and he in this regard relied on the judgment
rendered by this Court in the case of B. L. Prasad and others Versus State of U.P. and others and against the said judgment S.L.P. was preferred
before Hon''ble Apex Court, which has been dismissed.
The petitioner for redressal of his grievance has already represented the matter before the concerned Executive Engineer under whom he is
performing and discharging his duties.
In these circumstances and in this background liberty is given to the petitioner to make a fresh representation within four weeks from today
alongwith certified copy of this order before the concerned Executive Engineer under whom he is performing and discharging duties, who shall
proceed to consider his claim, preferably within three months from the date of production of certified copy of this order. Whatever decision is
taken be communicated to the petitioner.
With the above direction present writ petition is disposed of finally. No order as to costs.
