1. The applicant is working as Post Graduate Teacher (PGT) (Chemistry) in the Kendriya Vidyalaya Sangathan (KVS) and is posted at an institution
at Agra Cantonment. She made a representation to the respondents with a request to transfer her to an institution at Jaipur on the ground that her
husband is employed at that place. Her grievance is that no steps have been taken so far.
2. Heard Ms. Kavita Bhati, learned counsel for the applicant and Sh. S. Rajappa, learned counsel for the respondents.
3. As in the case of any other organization, there exists a facility in the KVS also, for posting an employee near to the place where his/her spouse is
working. However, much would depend upon the availability of vacancies and exigency of service. The question as to whether the applicant can be
transferred to an institution at Jaipur, needs to be examined by the respondents. The representation made by the applicant was to an authority at Agra.
It must be to the Commissioner of the Sangathan.
4. We, therefore, dispose of the OA, leaving it open to the applicant to make a representation to the Commissioner of the KVS, Delhi, within four
weeks from today. On receipt of such a representation, the authority shall pass an order within two weeks thereafter, in accordance with the policy
guidelines. It is also directed that if there exists a vacancy of PGT (Chemistry) in the institution at Jaipur, the feasibility of keeping that vacant till the
representation of the applicant is disposed of, shall be considered.
There shall be no order as to costs.
