Virendra Saran, J.@mdashThis is second bail application. I have heard learned Counsel for the applicant and learned Government advocate.

2. With this second bail application learned Counsel for the applicant has filed High School Certificate which goes to show that at the time of the incident the applicant was hardly 20 years of age. Moreover, according to the medical report which has been filed as Annexure-2 the prosecutrix was about 18 years of age and the doctor has opined that the vagina admitted two fingers easily.

3. In this view of the matter bail may be granted to the applicant.

4. Let applicant Sheo Ram Pal involved in Crime No. 88 of 1999, u/s 376/506, I.P.C. and Section 3(1) XII, SC/ST Act of P.S. Kotwali, Akbarpur district Ambedkar Nagar be released on bail on his furnishing a personal bond of Rs. 15,000 (Rupees fifteen thousand) and two sureties each in the like amount to the satisfaction of learned C.J.M. concerned.
