Heard.

This is first bail application filed by the applicant-accused under Section 439 of the Cr.P.C. for grant of bail, who is in custody since 23.08.2020 in

connection with Crime No.106/2020 registered at Police Station Langhadol, District Singrauli for the offences under Sections 327, 353, 332, 329, 333

of the IPC.

The allegation against the applicant is that he illegally demanded money from the public servant for consuming liquor and on refusal, he assaulted the

public servant and caused grievous injury by beating him with Lathi.

It is submitted that the applicant is innocent. He is in custody since 23.08.2020. Charge sheet has been filed. Trial will take time for conclusion. The

applicant has no criminal antecedent, therefore, there is no need to keep him in the custody further. Hence, he be enlarged on bail.

Learned PL has opposed the application stating that looking to the facts and circumstances of the case and manner in which the offence has been

committed by the applicant, if he is released on bail, no fair trial will take place, therefore, the applicant is not entitled to be released on bail. Hence, the

application be rejected.

Having considered the facts and circumstances of the case, in view of this Court, the applicant is not entitled to be released on bail. Hence, this

application is rejected.

However, it is made clear that if trial is not completed within six months from the date of his arrest, he may file fresh application for bail.
