This is third application filed under Section 439 of Cr.P.C. for grant of bail. The second application was dismissed as withdrawn by the Coordinate

Bench of this Court by order dated 11.08.2021 passed in M.Cr.C. No.36748/2021 and as the Hon'ble Judge has been transferred, therefore, this

application has been placed before this Court.

The applicant has been arrested on 01.02.2021 in connection with Crime No.803/2020 registered by Police Station â€" Janakganj, District Gwalior for

offence punishable under Sections 304-B, 34 of IPC.

It is submitted by Counsel for applicant that applicant is the husband of the deceased and he is in jail from 01.02.2021 but there is no progress in the

trial. However, copies of the order-sheets of the Trial Court has not been placed on record about the stage of trial.

It is submitted by Shri Lokendra Shrivastava that the deceased was married to applicant on 09.02.2020. There are specific allegations against the

applicant and his parents. On 13.10.2020, she committed suicide by handing herself i.e. within a period of eight months from the date of her marriage.

The father and mother of applicant are still absconding.

Considering the totality of facts and circumstances of the case coupled with the fact that parents of the applicant are still absconding, no case is made

out....

At this stage, Counsel for applicant seeks permission of this Court to withdraw this application.

It is, accordingly, dismissed as withdrawn.
