This petition under Section 482 of CrPC has been filed by the petitioners against the order dated 26.06.2023 by which application of the petitioners for allowing them to appear through video conferencing for the purpose of remand has been dismissed by learned Chief Judicial Magistrate Datia (M.P.) arising out of FIR registered under Section 420, 467, 468, 469, 471, 406, 409, 120-B of IPC at crime No.390/2018 at Police Station Kotwali District Datia.
The said application has been filed on the ground that the petitioners are lodged in Central Jail East Midnapur Kolkata in crime No. 47/2017 and petitioner no.1 is an ailing person whose treatment is going on.
After perusing the impugned order, this Court deems it appropriate to allow this petition.
Accordingly, petition is allowed.
Order dated 26.06.2023 is set-aside. Petitioners are permitted to mark their attendance through video conferencing.
