The petitioner wants to transfer the case No.47/2020 pending before the Principal Judge, Family Court, Morena to Family Court, Gwalior on the
ground that non-applicant/respondent is residing in Gwalior. Thus, the petition be transferred to Gwalior.
Heard the learned counsel for the petitioner.
From the record it appears that petition under Section 13(1) of Hindu Marriage Act has been filed by Dharmendra Kumar - petitioner before the
Principal Judge, Family Court, Morena in 2020. It has been further submitted that respondent has not appeared before the Court concerned so far.
Very surprising that petitioner has not been appeared for the last four years.
Having heard the learned counsel for the petitioner, no case is made out to transfer the petition from the Family Court, Morena to the Family Court,
Gwalior.
Accordingly, petition is dismissed.
