1. They are heard and perused the record.

This is first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of temporary bail on behalf of applicant has been arrested in relation to F.I.R./Crime No.102/2024 dated (not mentioned), registered at Police Station-Jaora, District-Ratlam (M.P.) for the offence under Sections 25, 27 of Arms Act. Applicant is in custody since 19.03.2024.

2 . Allegation against the applicant is that he is involved in the aforesaid offence wherein one pistol and two live cartridges were recovered.

3. Learned counsel for the applicant submitted that this case is related to offence under Section 25,27 of Arms Act and on account of criminal antecedents registered against the applicant, he has not filed application for regular bail application and instead of regular bail application, he has filed temporary bail application for marriage of his daughter which is scheduled on 27.04.2024 on the humanitarian ground. Applicant has also filed marriage invitation in this regard. Under these circumstances, counsel prays for grant of bail to the applicant.

3. Learned counsel for the State has opposed the prayer, however, it is fairly submitted that as per the invitation card, the marriage of the applicant's daughter is scheduled on 27.04.2024.

4. I have heard learned counsel for the parties and have perused the case diary.

5. In view of the aforesaid submissions and on perusal of the documents filed on record, this Court is inclined to allow the present temporary bail application for a period of one month from the date of his release.

6. It is directed that the applicant be released on temporary bail for a period of fifteen days (15 days) from the date of his release subject to furnishing a personal bond in the sum of Rs.50,000/- with one solvent surety in the like amount to the satisfaction of the trial Court for securing his presence before the said Court on all the dates of hearing fixed in this regard during trial. It is also directed that the applicant shall comply with the provisions of Section 437(3) Cr.P.C..

It is made clear that after having been completed the aforesaid period, the applicant may surrender before the Trial Court, failing which the concerned trial Court is having liberty to arrest the applicant in accordance with law. It is also made clear that after surrendering the applicant before the Court the cash security may be withdrawn by the concerning person as per rules from the trial.
