Though this matter is adjourned to 17.2.2023, the same has been mentioned by the counsel appearing on behalf of the respondent. Longish mentioning has been done.

It is submitted by the counsel for the respondent that the parties to this litigation are having a protracted discussion and they are going to arrive at a fruitful agreement which is acceptable to both the parties. It is submitted by the counsel for the respondent that it is the desire of the respondent that petitioner shall make payment directly to TELCOS on and from 1.2.2023. But nothing has been yet reduced in writing. The process of reduction in writing is going on. As and when the same is finalised, the same shall be placed before this Hon’ble Tribunal.

It is further submitted by the counsel for the respondent that as the parties to this litigation are in the process of agreement of most of the differences between them, it is expected by the respondent that TELCOS may not discontinue Bandwith with the parties to this litigation.

In view of the aforesaid submissions, it appears that there shall be novation of the contract/agreement between the parties to this litigation.

Hence, in view of these facts, the date of hearing of this T.P is preponed. The earlier date of 17.2.2023 is hereby cancelled and this matter will be listed on 8.2.2023.
