1. Mr. Swain, learned advocate appears on behalf of petitioner, a Self Help Group (SHG). He submits, supplies were made by his client, which remain unpaid. He draws attention to annexure-4 series. He submits, dues of his client were assessed and ascertained at Rs.27,20,379.42. This was done by the Child Development Project Officer (CDPO). On query from Court he submits, his client will accept said amount in full and final settlement, on it being paid forthwith.
2. Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and prays for adjournment to obtain instructions.
3. Court does not require instructions to be issued for submissions being made. This is because there cannot be any dispute regarding assessment of total amount to be drawn by petitioner made by the CDPO at Rs. Rs.27,20,379.42. Petitioner having been engaged for implementation of Government scheme, it is entitled to payment. There is no dispute with regard thereto. The payment can be enforced by direction in exercise of writ jurisdiction.
4. The sum, assessed at Rs.27,20,379.42, is to be sanctioned and disbursed to petitioner by concerned authorities within four weeks of communication.
5. Mr. Sharma prays for six weeks. Court is not inclined to grant more time since the supplies were made from year 2014 to year 2017. Said sum must be paid within four weeks of communication, failing which there also must be paid interest at 5% per annum simple on the sum calculated from July, 2014 till the date of payment. If aggregate accrued interest is to be paid on the contingency directed, it is to be treated as cost paid. Mr. Swain prays for leave to correct the cause title. Leave is granted for the correction to be made and counter signed by Court Master.
6. The writ petition is disposed of.
