S. Jagadeesan, J.@mdashThe Petitioner has filed this Habeas Corpus Petition for the protection of his daughter, by name Kavitha.
2. In the affidavit filed in support of this petition, he has alleged that the Respondents 1 to 3 had threatened his daughter and taken away as the first Respondent wanted to marry her and the Petitioner herein refused to give consent for the marriage.
3. Now the police have apprehended the detenu. However, it is represented by the police that the Respondents 1 to 3 are absconding. The custody of the minor daughter had been entrusted to the Petitioner. The minor daughter, the detenu is also present in court and when we enquired she expressed her willingness to go with her father. Since the minor daughter of the Petitioner had been apprehended and the custody had been handed over to the Petitioner, nothing survives in this Habeas Corpus Petition and the same is dismissed.
4. It is represented by the additional public prosecutor that the complaint given by the Petitioner against the Respondents 1 to 3 had already been registered as crime No. 524 of 2001 u/s 363 I.P.C. on the file of the 4th Respondent herein and the investigation is going on. The fourth Respondent is directed to complete the investigation as early as possible and also further directed to apprehend the Respondents 1 to 3 and proceed in accordance with law.
