R. Sudhakar, J.@mdashHeard Mr. M. Suresh, learned counsel appearing for the petitioner and Mr. B. Pugalendhi, learned Special Government Pleader appearing for the respondents. By consent, the writ petition itself taken up for final disposal. The petitioner in this case sought permission for conducting "Kabadi Tournament" to be conducted on 13.01.2014 and 14.01.2014 which was rejected by the sub Inspector of Police, the second respondent herein citing law and order problem and also due to another festival namely Gnanaratham to be held on the said date.

2. We have perused the order of the second respondent. The main reason for rejecting the claim is that there is Gnanaratham festival and Pongal festival on 13.01.2014 and 14.01.2014.

Now, it is submitted by the learned counsel for the petitioner that they are willing to change the date for the Kabadi Tournament on 18.01.2014 and 19.01.2014 and the petitioner is prepared to abide by any condition that may imposed by the respondent, if the second respondent grants permission for conducting Kabadi Tournament.

4. Mr. B. Pugalendi learned Special Government Pleader would submit that in the event of this Court granting permission, stringent conditions may be imposed for the smooth conduct of the event.

Taking note of the fact that the petitioner is going to organise only Kabadi Tournament, keeping it open to everyone from his village and outside the village, beyond religion, caste, community feelings, this Court finds no impediment to allow the conduct of Kabadi Tournament event, on 18.01.2014 and 19.01.2014. The petitioner is granted permission to conduct Kabadi Tournament subject to the following conditions:-

i) The Kabadi Tournament is permitted to be held on 18.01.2014 and 19.01.2014 between 10.00 a.m. to 07.00 p.m. only.

ii) The petitioner and other participants shall not shout, raise any slogan for or against any party or party leader, any cast, community or creed.

iii) The petitioner shall ensure that no untoward incident is caused disturbing the public peace and tranquility;

iv) The petitioner shall ensure proper first aid arrangements by keeping one or two doctors in the venue.

v) The participants of Kabadi Tournament shall not wear any form of dress showing offending slogans or picture of any communal/political leader which may cause disturbance,"

vi) Songs praising communal leader or having communal overtones should not be played.

vii) The petitioner will ensure that no flex board or hoardings depicting particular community or leader will displayed.

viii) The petitioner shall donate a sum of Rs. 2,000/- (Rupees two thousand only) to the Blind School, Sundarajanpatti, Azhagarkoil Road, Madurai and payment of proof shall be produced before the second respondent.

6. If any of the above said conditions are violated, it is open to the respondents to take appropriate action, in accordance with law. The writ petition is disposed of the above terms. No costs.
