1. Heard Sri.Praveen K.Joy, learned counsel for the petitioners as well as Sri.S.Easwaran, learned Standing Counsel appearing for the respondents.
2. The present writ petition has been filed seeking following reliefs:
“(i) To issue direction to the Debt Recovery Tribunal â€" II, Ernakulam to take up and pass orders on Ext.P2 stay petition in S.A No.396/2023 within a time
limit fixed by this Hon’ble Court, in the interest of justice.
(ii)To issue direction to the respondents to keep in abeyance all further actions and recovery proceedings under Ext.P3 till orders are passed by the Debts
Recovery Tribunal-II, Ernakulam in Ext.P2 stay petition, in the interest of justice.
(iii) Dispense with the filing of translation of vernacular documents.
(iv) To grant such other reliefs which this Hon’ble court may deem fit and proper, in the interest of justice.â€
3. Learned counsel for the petitioners as well as learned counsel for the Bank submitted that the next posting date fixed for the Tribunal is 11.09.2023.
4. Considering the aforesaid fact, the writ petition is disposed of with direction to the Tribunal to decide the Stay Petition of the petitioners in S.A
No.396 of 2023 on 11.09.2023.
5. With the aforesaid direction to the Tribunal, the present writ petition finally disposed of.
