1. Rule returnable forthwith. Learned APP waives service of notice of rule for and on behalf of the respondent-State.

2. The present application is filed seeking temporary bail for a period of 30 days on the ground of medical treatment of the father of the applicant who is suffering from cancer. The medical case papers issued by the Gujarat Cancer and Research Institute, Ahmedabad appended to the application suggests that the father of the applicant is suffering from a last stage of cancer.

3. Considering the facts of the case and taking into consideration the grounds urged in the application, the applicant-convict is ordered to be released on temporary bail for a period of 10 (TEN) days from the date of his actual release, upon executing a bond of Rs. 5,000/- to the satisfaction of the concerned authority, on usual terms and conditions.

4. The applicant – convict shall mark his presence before the concerned police station twice in a week during the temporary bail period. The applicant shall surrender before the jail authority on or before the expiry of the temporary bail period, without fail.

5. Rule made absolute to the aforesaid extent. Direct service is permitted.
