1. Rule. Learned APP waives service of notice of Rule.

2. By way of the present application, the applicant has prayed to release him on temporary bail on the ground of attending after death ceremony of grandmother of the applicants – accused. In support of it, death certificate is produced on record.

3. I have heard learned advocates appearing for the parties and have also perused the documents produced along with the application as well as considered the averments made in this application including jail report. It is found out from the jail report that till date, the applicants have not availed any leave, however, considering the grounds mentioned and the averments made in the application, the present application deserves to be allowed.

4. Therefore, the present application stands allowed partly. The applicants are ordered to be released on temporary bail for a period of 15 (Fifteen) Days from the date of their actual release, on executing personal bond of Rs.5,000/- (Rupees Five Thousand) each before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.

5. The applicant shall surrender before Jail Authority on completion of temporary bail, without fail.

6. Rule is made absolute to the aforesaid extent. Direct service is permitted.
