I.A. No.03 of 2022 is an application filed by the Petitioners seeking stay of the Order of the Learned Judicial Magistrate, First Class, East Sikkim, at

Gangtok, in Private Complaint Case No.09 of 2020: Shri Santiago Martin vs. Dr. T. M. Thomas Isaac and Others, dated 02-03-2021, wherein the

Learned Trial Court had found sufficient materials to proceed against the Petitioners under Sections 499, 500, 501, 502 and 120 B of the Indian Penal

Code, 1860.

Although the prayer for stay is opposed by Learned Counsel for the Respondent No.1, in the facts and circumstances, I am of the considered opinion

that the impugned Order dated 02-03-2021 of the Learned Trial Court be stayed, as before, till the matter is finally heard by this Court on 31-08-2022.
