Heard learned counsel for the appellant and the learned counsel for the State on the Interlocutory Application filed by the appellant for granting bail
during the pendency of this appeal.
The appellant has been convicted and sentenced for the offences under Section 395 of the Indian Penal Code and Sections 25(1-B)(a), 26 / 35 of the
Arms Act. The impugned Judgement shows that the informant, who is the victim of the case, has not identified the appellant in the Court. The
appellant was on bail during trial.
In the facts and circumstances of this case, we are inclined to release the appellant, Md. Rizwan Alam, on bail. Accordingly, the appellant named
above, is directed to be released on bail during the pendency of this appeal, on furnishing bail bond of Rs.10,000/- (ten thousand), with two sureties of
the like amount each, to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, Gumla, in connection with S.T. No. 185 of 2018 /
S.T. No. 87 of 2018.
The aforesaid interlocutory application stands allowed.
