The anticipatory bail application filed on behalf of petitioner, who is apprehending his arrest in connection with Radhanagar P.S. Case No. 155 of 2023 for the offence registered under Sections 290, 420/34 of the Indian Penal Code and Section 11 of Bengal Gambling Act pending in the Court of learned Judicial Magistrate, 1st Class, Rajmahal, is pressed into motion.

As per the prosecution case, the police conducted raid on the information that some persons were involved in gambling. On the approach of police party, some persons fled away and two were apprehended and the motorcycle of the petitioner was found at the place of occurrence.

It is submitted by the learned counsel on behalf of the petitioner that there is no material except for the seizure of the motorcycle and he has no criminal antecedent.

Learned A.P.P. has opposed the prayer for bail.

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioner, above named, is directed to surrender before the learned trial court within a period of two weeks and in the event of his arrest or surrender, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The petitioner will co-operate with the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the conditions as laid down under Section 438(2) of the Cr.P.C.
