1. By the instant petition, the petitioner has challenged legality, validity and propriety of the order dated 4-7-2013, whereby the defendant / petitioner's

application under Section 24 of the Hindu Marriage Act, 1956 has been rejected during the pendency of application under Section 13 of the said Act.

2. Learned counsel for the petitioner submits that during the pendency of this writ petition, the application under Section 13 of the Hindu Marriage Act,

1956 has already been rejected by the Family Court and appeal is pending consideration before this Court.

3. Since the application under Section 13 of the Hindu Marriage Act, 1956 has already been rejected, this writ petition cannot continue and is hereby

closed. However, the petitioner is at liberty to file application under Section 24 of the Hindu Marriage Act, 1956 before the appellate court. No order

as to cost(s).
