Rakesh Kumar Garg, J.@mdashThe plaintiff has filed this revision petition under Article 227 of the Constitution of India for issuance of an
appropriate direction to the Civil Judge, Senior Division, Ludhiana for deciding the case S.A. No. 39 dated 01.02.2003 titled as Ajit Kaur v.
General Public and Anr. pending for 10.03.2009 in the Court of Sh. Lachhman Singh, Civil Judge, Senior Division, Ludhiana, expeditiously
preferably on day to day basis.
2. The contention raised by the petitioner is that he is a senior citizen and the case is lingering on for the last many years and therefore the direction
be given to the Civil Judge (Sr. Divn.), Ludhiana to decide the case expeditiously, preferably on day to day basis.
3. I have heard learned Counsel for the petitioner and perused the various zimni orders passed by the trial Court as reproduced in the revision
petition. In this case, issues were framed on 19.07.2006 and thereafter the plaintiff is leading his evidence. No doubt, on certain dates, the case has
been adjourned on request of parties, yet, it is a matter of fact that at no stage counsel for the petitioner had opposed the adjournment. Learned
Counsel for the petitioner was unable to point out any unnecessary adjournment in the case. Thus, I find no reason to give a direction to the Civil
Judge, Senior Division, Ludhiana for deciding the case expeditiously, preferably on day to day basis.
4. Dismissed.
