Alok Singh, J.@mdashLearned Counsel for the petitioner-tenant states that he has been instructed by the petitioner-tenant to withdraw this petition. He further states that he has been instructed by the petitioner to undertake that petitioner shall hand over vacant physical peaceful possession to the respondent -landlord on or before 31.05.2011. Learned Counsel for the petitioner further undertakes, on the instructions of the petitioner, that mesne profits at the rate of agreed rent shall be paid to the respondent-landlord on or before 10th day of each and every month. He further undertakes that entire arrears shall be paid within eight weeks from today.
2. Petition is dismissed as withdrawn. However, orders impugned shall not be executed against the petitioner-tenant till 31.05.2011 provided petitioner furnishes undertaking in the shape of affidavit before the learned Rent Controller to the above effect within four weeks from today. It is made clear if undertaking is not furnished or any breach thereof is committed, then eviction order shall be executed forthwith.
