1. For the reasons shown in the application, C.M. is allowed.

2. Order dated 7.10.2010 is recalled and writ petition is restored to its original number.

C.W.P. No. 16295 of 1990

3. By way of present petition, Petitioner - Municipal Corporation is assailing order/award dated 26.4.1990 passed by Labour Court, Ludhiana

thereby directing resin statement of Respondent No. 2 with full back wages.

4. Impugned order was passed way back in 1990. It is fairly stated by learned Counsel for the Petitioner that workman - Respondent No. 2 is

working regularly since then and his services has already been regularised in the year 1992. In these peculiar facts and circumstances of the case

after expiry of 20 years, I do not intend to invoke extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India.

Dismissed.
