1. As per pleadings on record, petitioner is serving on the post of Lecturer (Nursing) in the Baba Farid University of Health Sciences, Faridkot.
2. Placed on record at Annexure P-6 is a provisional seniority list of certain Lecturers/Assistant Professors (Nursing) of all the constituents nursing
institutions of the University dated 07.11.2019 (Annexure P-6). Name of the petitioner is reflected at Sr. No. 4 of such provisional seniority list
showing her date of joining as 11.07.2012. Vide Annexure P-6 itself objections were also invited if any within a period of 30 days as against the
provisional seniority reflected therein.
3. The instant writ petition has been filed raising a limited prayer that the objections submitted by the petitioner against the provisional/tentative
seniority list that had been filed within the stipulated time frame of 30 days be decided by the competent authority in the University.
4. The prayer raised in the petition is found to be just and reasonable.
5. The University having issued a tentative seniority list and having invited objections to the same would be obligated to consider objections filed by an
employee as regards placement of seniority in the provisional seniority list.
6. The objections/representation dated 15.11.2019 received on 18.11.2019 stand appended as Annexure P-9.
7. In view of the above and without opining on the merits of the case, writ petition is disposed of with a direction to respondent No. 1 to consider the
objections/representation dated 15.11.2019 (Annexure P-9) strictly in accordance with law and as per applicable Rules/Instructions/guidelines on the
subject and to pass a final order thereupon within a period of two weeks from the date of receipt of a certified copy of this order.
8. It is directed that till such date, the objections at Annexure P-9 are not decided, the provisional seniority list at Annexure P-6 shall not be acted
upon.
