Instant petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 for issuance of a direction to the respondents to take
appropriate action by conducting fair and impartial investigation in FIR No.381 dated 30.09.2021 registered for offences under Sections 376-D and 506
of the Indian Penal Code, 1860 and Section 6 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Ferozepur Jhurka,
District Nuh.
Counsel for the petitioner submits that the petitioner is the complainant and uncle of the minor victim, who has been raped by Wasim son of Ayub and
Mohabbat son of Gunni. He submits that despite representations, the accused have not been arrested and no action has been taken pursuant to the
FIR.
Notice of motion.
On asking of the Court, Ms. Mahima Yashpal, DAG, Haryana accepts notice on behalf of the respondents. As per instructions, received by her, from
ASI, Ravi Kant, accused, Wasim, has been arrested on 25.01.2022 and numerous raids have been conducted to arrest accused - Mohabbat.
Considering the nature of allegations levelled in the FIR, this Court deems it appropriate to dispose of the petition by directing the Superintendent of
Police, Nuh-Mewat, District Nuh-Mewat, respondent No.3, to examine the representation, Annexure P-4, which has been submitted during the
pendency of the instant petition, and take suitable action thereon as warranted in accordance with law.
A copy of this order as well as the representation, Annexure P-4, be communicated to respondent No.3 to enable him to do the needful expeditiously.
