V. Jagannathan

1. Heard learned counsel for the petitioner and learned HCGP for the respondent-State. Dismissal of the application filed u/s 311 of Cr.P.C. by the trial court is the cause for this petition being filed u/s 482 of Cr. P. C.

2. Petitioner''s counsel submit that on the day when the matter was posted for cross-examination of PWs 1 and 2, counsel for the petitioner could not be present doe to fever and therefore, one more opportunity be given to the petitioner to cross-examine PWs 1 and 2. Taking the above submission into account, petition is allowed and the impugned order is set aside. Petitioner is permitted to cross-examine PWs 1 and 2 on the day to which the case will be posted by the trial court and no further time shall be taken by the petitioner and further, petitioner shall pay cost of Rs.1,000/- to each of the two witnesses i.e., PWs 1 and 2.
