Prashant Kumar, J.@mdashAnticipatory bail application filed by Dayanand Kumar, is moved by Sri Manoj Tandon, learned Counsel for the Petitioner and opposed by Sri Amaresh Kumar, learned Additional P.P. for the State.

2. It is alleged that co-accused Pradeep Kumar Mehta got advance of Rs. 2 lakhs and odd on the recommendation of Petitioner. It further appears from the certified copy of order dated 01.07.2009 in A.B.A. No. 1992 of 2008 that aforesaid Pradeep Kumar Mehta has been granted anticipatory bail, because he deposited said amount in State exchequer.

3. Considering the aforesaid facts and circumstances, I allow this application and direct the Petitioner above named to surrender in the court below by 19th of April, 2011 and in the event of his surrender, the learned court below is directed to enlarge him on bail on his furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Koderma, in connection with Markacho P.S. Case No. 46 of 2008 correspondingto G.R. No. 292 of 2008, subject to the condition as laid down u/s 438(2) of the Code of Criminal Procedure
