Narendra Nath Tiwari, J.@mdashIn this writ petition, the Petitioner has prayed for a direction on the Respondents to pay him the entire benefits of V.R.S. Scheme with statutory interest.

2. Learned Counsel for the Petitioner submitted that the Petitioner is permanent employee of the Respondents since 1990. Due to his physical and mental disturbance, he could not attend his duty regularly since 2000-01 and, therefore, the Petitioner had sought voluntary retirement under the V.R.S. Scheme with admissible benefits by his representation dated 12th September, 2000. When No. order was passed on his representation, he left the services of the Respondents and shifted to his village Biramdih, P.S. Balrampur, District Purulia (West Bengal), where the Petitioner has been living. The Petitioner even after shifting his residence to his native place has been making representation for giving information regarding the fate of his application for voluntary retirement under the V.R.S. Scheme, but till date the Petitioner has not received any information from the Respondents. The Petitioner has also not received the monetary benefit including other benefits, which are admissible to an employee going on voluntary retirement.

3. Learned Counsel appearing on behalf of the Respondents submitted that if the Petitioner''s representation is still pending or if he files fresh representation, the same shall be considered and appropriate order shall be passed by the competent authority.

Considering the said submissions, this writ petition is disposed of, giving liberty to the Petitioner to file a fresh representation, along with a copy of this order, before the General Manager, BCCL, Sudamdih Colliery-Respondent No. 2. On receipt of the representation, the said Respondent shall consider the same and pass appropriate reasoned order within a period of six weeks from the date of receipt of the representation.
