A.M. Khanwilkar, C.J.@mdashHeard counsel for the parties. The petitioner had applied pursuant to the advertisement, dated 13th December, 2011, for the post of PGT (IT) in Education Department. The petitioner was permitted to appear in the written test and her results were also declared. She was successful in the written test, as a consequence of which she was invited for interview. However, at the time of interview, she was informed that her candidature cannot be considered as she was ineligible. The fact that the petitioner was allowed to appear in the written examination and her results were declared or that she was called for interview cannot create any right in favour of the petitioner. The Authorities rejected her nomination on the basis of the condition specified in the advertisement that the candidate should be eligible and fully qualified for the post for which he/she has applied, on the last date fixed for the receipt of the application. It is not in dispute that the last date for receipt of application was 12th January, 2012. The petitioner was declared successful in B.Tech. only in June, 2012. In the application filed by her, she has candidly stated under column ''percentage'' that she was awaiting the results of B.Tech. In short, the petitioner was not eligible to apply for the said post on 12th January, 2012, which was the last date for receipt of the application.
In the circumstances, no fault can be found with the decision of the Authority in not allowing the petitioner to appear in the interview, though invited for that purpose, being ineligible. Accordingly, the petition fails and the same is dismissed, so also the pending application(s), if any.
