R.R. Tripathi, J.@mdashMr.K.V. Shelat points out that the petitioner, Shri Rameshchandra U. Bariya, has expired on 5.10.1998 and therefore, a Civil Application is filed on 16.6.2000, before the Court, the papers of which are called from the Registry.
2. Said Civil Application is filed for bringing the heirs on record and also to place certain documents about the latter developments in the matter. In the interest of justice that Civil Application was granted.
3. This is the matter, which was filed in 1988 and the poor petitioner died on 5.10.1998, awaiting disposal of the petition. Now his heirs are brought on record. It is expected of the GIDC, respondent no.1 herein to expedite the implementation of the communication dated 8.1.1993 as well as the subsequent letter pursuant thereto.
4. In view of the contents of the letter dated 8.1.1993, (Annexure ''I'') and subsequent letters dated 20.6.1995 and 18.2.1998, and subject to the aforesaid observations, this Special Civil Application is sought to be withdrawn. The permission is granted. The Special Civil Application stands disposed of as withdrawn with no order as to costs. Rule is made absolute. Interim relief is vacated.
