Amendment Made By Section 2 To Have Retrospective Effect Andhra Pradesh (Andhra Area) Agriculturists Relief (Amendment) Act, 1949 5 of 1949 [22 March 1949] An Act further to amend [the Andhra Pradesh (Andhra Area) Agriculturists Relief Act, 1938.] Whereas it is expedient further to amend 2[the Andhra Pradesh (AndhraArea) Agriculturists' Relief Act, 1938], for the purpose hereinafter appearing; It is hereby enacted as follows:- 1. For Statement of Objects and Reasons, see Fort St. George Gazette, dt. 28-12-1948, Pt. IV-A. p. 442. 2. Substituted for the original short title by A.P. Act IX of 1961. 1. Short Title :- This Act may be called 1[the Andhra Pradesh (Andhra Area) Agriculturists Relief (Amendment) Act, 1949.] 1. Substituted for the original short title by A.P. Act IX of 1961. 2. Section 2 :- Amendment made by this section has been incorporated in Act IV of 1938. 3. Amendment Made By Section 2 To Have Retrospective Effect :- The amendment made by this Act shall apply to- (i) all suits and proceedings instituted after the commencement of this Act; (ii) all suits and proceedings instituted before the commencement of this Act, in which no decree or order has been passed, or in which the decree or order passed has not become final, before such commencement; and (iii) all suits and proceedings in which the decree of order passed has not been executed or satisfied in full before the commencement of this Act: Provided that no creditor shall be required to refund any sum which has been paid to or realized by him, before the commencement of this Act.
