Amendment of section 12 of Assam Act XVII of 1993 Assam Backward Classes Commission (Amendment) Act, 1995 05 of 1995 [18 April 1995] PREAMBLE An Act further to amend the Assam Backward Classes Commission Act, 1993. Whereas it is expedient further to amend the Assam Backward Classes Commission Act, 1993 (Assam Act XVII of 1993), herein after referred to as the principal Act, in the manner hereinafter appearing; It is hereby enacted in the Forty-sixth Year of the Republic of India as follows:- 1. Short title and Commencement :- (1) This Act may be called the Assam Backward Classes Commission (Amendment) Act, 1995. (2) It shall come into force at once. 2. Amendment of the preamble of Assam Act, XVII of 1993 :- I n the principal Act, in the preamble, for the words "for the members of socially and economically backward sections of the society" occurring after the word "posts" and before the word "and" the words "in favour of any socially and educationally backward classes of citizens" shall be substituted. 3. Amendment of section 2 of Assam Act XVII of 1993 :- In the principal Act, in section 2, after clause (g) the following shall be inserted as clause 1(h), namely:-- "(h) "process fees" means fees for publication, service of notices or for summoning the witnesses". 4. Amendment of section 12 of Assam Act XVII of 1993 :- In the principal Act, in section 12 after sub-section (2) the following shall be inserted as sub-section (3) thereto, namely:-- "(3) Notwithstanding anything contained in sub-section (2); the Commission may however recover such sums as process fees as fixed by the Government from time to time While performing its functions under sub-section (1) of section 9 of the Act from the parties."
