Repeal and Saving Assam Municipal (Validation Of Elections) Act, 1957 08 of 1957 [19 July 1957] PREAMBLE An Act to provide for the validation of Municipal Elections Whereas it is expedient to provide for the validation of certain Municipal Elections: It is hereby enacted in the Eighth Year of the Republic of India, as follows:- 1. Short title and extent :- (1) This Act may be called the Assam Municipal (Validation of Elections) Act, 1957. (2) It extends to the whole of Assam. 2. Definition :- In this Act "the said Act" shall mean the Assam Municipal Act, 1923 (Assam Act I of 1923). 3. Validation of Elections :- If, for reasons sufficient to the satisfaction of the Governor, a general election could not be held in any Municipality before the lapse of four years as prescribed by sub-section (1) of Section 17 of the said Act, the Governor may fix a date for such general election at any time within nine months from the date on which the said four years lapsed and thereupon the general election shall be held in accordance with the provisions of the said Act and the rules made thereunder and such general election shall be valid for all purposes notwithstanding any provisions in the said Act. 4. Repeal and Saving :- (1) The Assam Municipal (Validation of Elections) Ordinance, 1957 (Assam Ordinance II of 1957), is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken in the exercise of the powers conferred by or under this Act, as if this Act were in force on the date on which such thing was done or action was taken.
