Continuance of nominated Members/Councillors Assam Panchayati Raj (Fifth Amendment Act, 1977 11 of 1977 [21 June 1977] PREAMBLE An Act further to amend the Assam Panchayati Raj Act, 1972. Whereas it is expedient further to amend the Assam Panchayati Raj Act, 1972 hereinafter called the principal Act, in the manner hereinafter appearing; It is hereby enacted in the Twenty-eighth year of the Republic of India as follows:- 1. Short title, extent and commencement :- (1) This Act may be called the Assam Panchayati Raj (Fifth Amendment) Act, 1977. (2) It shall have like extent as the principal Act. (3) It shall come into force at once. 2. Amendment of Section I of Assam Act XI of 1973 :- I n sub-section (2) of Section 1 of the principal Act, between the words "village" and "in" the words "and the tea garden areas" shall be inserted. 3. Amendment of Section 9 of Assam. Act XI of 1973 :- In sub-section (1) of Section 9 of the principal Act, clause (c) shall be deleted. 4. Amendment of Section 20, of Assam Act XI of 1973 :- In sub-section (1) of Section 20 of the principal Act, clause (d) shall be deleted. 5. Continuance of nominated Members/Councillors :- Notwithstanding anything in the principal Act or the rules framed thereunder, the Councillor or Councillors nominated under clause (d) of subsection (1) of Section 20 of the principal Act to a Mohkuma parishad from tea garden areas and the member nominated to a Gaon Panchayat under clause (c) of sub-section (1) of Section 9 from the adjacent tea garden areas of the Gaon Panchayat shall continue to be such Councillor or Members as the case may be, till the expiry of the current term of the Mohkuma Parishad or Gaon Panchayat.
