Insertion of New Section 15A after Section 15 of Assam Act XX of 1976 Assam Public Premises (Eviction Of Unauthorised Occupants) (Amendment) Act, 1977 04 of 1978 [12 April 1978] PREAMBLE An Act to amend the Assam Public Premises (Eviction of Unauthorised Occupants) Act. 1971. Whereas it is expedient to amend the Assam Public Premises (Eviction of Unauthorised Occupants) Act, 1971(Assam Act XX of 1976), hereinafter called the principal Act, in the manner hereinafter appearing; I t is hereby enacted in the Twenty-eight year of the Republic of India as follow:-- 1. Short title extent and Commencement :- (1) This Act may be called the Assam Public Premises (Eviction of Unauthorised Occupants) (Amendment) Act, 1977. (2) It shall have like extent as the Principal Act. (3) It shall come into force on the first of the date or dates on which either the whole or any part of the principal Act comes into force. 2. Insertion of New Section 15A after Section 15 of Assam Act XX of 1976 :- In the principal Act, after Section 15, the following new Section 15A with the marginal head shall be inserted, namely:-- "15A. Bar of Jurisdiction.-- No Civil Court shall have jurisdiction to entertain any suit or proceeding in respect of eviction of any person who is in unauthorised occupation of any public premises or the recovery of the arrears of rent payable under sub-section (1) of Section 7 or the damages payable under sub-section (2) of that Section or costs awarded to the Government of Assam under sub-section (5) of Section 9 or any portion of such rents, damages or costs".
