Saving SCHEDULE 1 :- SCHEDULE BORDER SECURITY FORCE (ASSISTANT COMMANDANTS) RECRUITMENT RULES, 1985 G.S.R. 137, dated the 28th January, 19851-In exercise of the powers conferred by Cl. (b) of sub-section (2) of Sec. 141 of the Border Security Force Act, 1968 (47 of 1968) and in supersession of the Ministry of Home Affairs letter No. 6/1/73- CLO/BSF/(Pers. 1), dated the 16th January, 1974, except as respects things done or omitted to be done, the Central Government hereby makes the following rules regulating the method of recruitment to the post of Assistant Commandant in the Directorate General, Border Security Force, namely : 1. Short title and commencement :- (1) These rules may be called the Border Security Force (Assistant Commandant) Recruitment Rules, 1985. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number, classification and scale of pay :- Number of post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age limit, qualifications, etc :- The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the Schedule afoiesaid. 4. Initial constitution :- All officers holding the post of Assistant Commandant, on the date o f commencement of these rules shall be deemed to have been appointed in accordance with the provisions of these rules. 5. Maintenance :- Subject to the initial constitution of the service every post remaining unfilled and every vacancy that may arise thereafter shall be filled in accordance with the provision contained in Schedule, by appointment on promotion, deputation/transfer, re- employment after retirement or direct recruitment as the case may be. 6. Disqualification :- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living, has entered into or contracted a marraige with any person, shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doirtg, exempt any person from the operation of this rule. 7. Ineligibility of aliens :- N o person who is not a citizen of India shall, except with the consent of the Central Government signified in writing, be appointed, enrolled or employed in the Border Security Force: Provided that nothing contained in this rule shall bar the appointment, enrolment or employment of a subject of Nepal, Sikkim or Bhutan in the Border Security Force. 8. Power to relax :- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 9. Saving :- Nothing in these rules shall effect reservations, relaxation of age limits, and other concessions, required to be provided for the Scheduled Castes, the Scheduled Tribes and other categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.
