Saving SCHEDULE 1 :- SCHEDULE CENTRAL ADMINISTRATIVE TRIBUNAL (GROUP 'C' AND GROUP 'D' POSTS) RECRUITMENT RULES, 1987 G.S.R. 161, dated 18th February, 1987 1.-In exercise of the powers conferred by sub-sections (1) and (2) of Sec. 13 of the Administrative Tribunals Act, 1985, the Central Government hereby makes the following rules regulating the method of recruitment to Group 'C' and 'D' posts In the Central Administrative Tribunal, namely: 1. Short title and commencement :- (1) These rules may be called the Central Administrative Tribunal (Group 'C and 'D' Posts) Recruitment Rules, 1987. (2) They shall come into force on the date1 of their publication in the official Gazette. 1. Enforced w.e.f. 14th March, 1987. 2. Application :- These rules shall apply to the posts mentioned in the column I of the Schedule annexed to these rules. 3. Number of posts, classification and scale of pay :- The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 5 of the said Schedule. 4. Method of recruitment, age limit, qualifications, etc. :- T h e method of recruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns 6 to 14 of the Schedule aforesaid. 5. Absorption/Regularisation of existing employees. :- (1) Notwith- standing anything contained in these rules, persons already working with the Tribunal either on transfer or on deputation basis or on direct recruitment and who fulfil the qualifications and experience, laid down in these rules for direct recruits and who are considered suitable by the Chairman would also be eligible for absorption/regularisation subject to the condition that such deputationists exercise their option therefor and that their parent Departments do not have any objection to their being absorbed in the Tribunal. (2) The seniority of officers/officials mentioned in sub-rule (1) shall be determined with reference to the dates of their regular appointment to the posts concerned: Provided that the seniority of officers/officials recruited from the same source and in the same posts as held by them in the parent Department shall not be disturbed. 6. Disqualification :- No person- (a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any other person; shall be eligible for appointment to any post in the Tribunal : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule. 7. Power to relax :- Where the Chairman is of the opinion that it is necessary or expedient so to do, he may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 8. Saving :- Nothing in these rules shall affect reservations, relaxation of age limits and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issuer by the Central Government from time to time in this regard.
