No.1236-955-XIII, dated 31-5-22Slaughter house licenses :- (1) No Slaughter house shall be established or maintained except under license from the Deputy Commissioner of the district in which it is situated. (2) For each licenses the Deputy Commissioner may, with the previous sanction of the Commissioner of the division, levy a fee not exceeding Rs. 200. (3) The Deputy Commissioner may, for reasons to be recorded in writing, refuse to grant a license, or cancel or suspend a license. (4) An appeal from any other passed under sub-rule (3) shall lie to the Commissioner within 30 days of the date of such order. (5) A license granted shall be in form A. Site and building. (6) License shall not be given unless the site and plan of the proposed slaughter-house have received the approval of the Deputy Commissioner and the Director of Public Health. Before approving the site the Deputy Commissioner shall consult any local bodies exercising jurisdiction over or in the vicinity of the site. (7) The Deputy Commissioner may, at any time, by order in writing require the license of a slaughter house to make within a reasonable time such alterations as he may declare to be necessary for maintenance of the slaughter in a sanitary condition. 2. xxx :- 3. Supervisors :- The Deputy Commissioner shall appoint for each slaughter-house in his district a supervisor and such assistant supervisors as he may consider necessary, and may delegate to such assistant supervisor such of the duties and powers of the supervisors under these rules as he deems proper. 4. Duties of the Supervisors :- (1) The duties of the supervisor within the limits of the slaughter- house shall be -- (a) to examine and reject, detain, or pass all animals brought for slaughter; (b) to supervise the slaughtering of animals and their treatment before slaughter; (c) generally, to perform all duties imposed upon him by these rules and to report to the Deputy Commissioner or Sub-Divisional Officer any breach of the Act or of these rules or of any regulation or order issued by the Deputy Commissioner or by an Inspector under these rules. (2) The supervisor within the limits of the slaughter-house for which he is appointed shall have power- (a) to inspect any part of the premises; (b) to call for information from occupiers or their employers in regard to matters concerning his duties and to record statements about such matters; (c) to do any act which may be necessary to the proper performance of his duties. 5. Animals Examination :- Every animal brought for slaughter at a slaughter-house shall be presented for examination by the supervisor. 6. The following animals shall be rejected and returned to the owner :- (1) Any animal which in the opinion of the supervisor is (a) pregnant, or (b) in milk. (2) All cows. (3) Any animal other than sheep or goats which in the opinion of the supervisor is of or under the age of 9 years. 7. Any animal suspected to be suffering from anthrax, tuberculosis, black :- quarter, hemorrhage septicemia or rinderpest or from any other disease declared by the Local Government to be injurious to health may be detained in a special detention pen appointed by the Deputy Commissioner for a period not exceeding 12 hours to enable the supervisor to complete his examination. 8. xxx :- Any animal suffering from the diseases specified in rule 7 and presented for slaughter shall be slaughtered in such place and in such manner as the Deputy Commissioner may direct. 9. Explanation :- The supervisor shall reject any animal which may reasonably be suspected to be stolen property and shall immediately report the fact to the nearest police station. An animal may reasonably be suspected to be stolen property when its value for slaughter is appreciably less than its value for other purposes. 10. xxx :- (1) Every animal passed for slaughter shall be marked with a distinguishing mark, and shall be confined in a place appointed by the Deputy Commissioner to be called the "passed pen" until it is removed for slaughter. (2) The distinguishing marks affixed on any animal shall be such as may be affixed and removed painlessly. 11. xxx :- The supervisor may examine the flesh, hide or bones of any animal slaughtered in the slaughter-house, and may seize and remove any such flesh, hide or bones as in his opinion are affected by any of the diseases mentioned in rule 7. 12. Destruction of diseased flesh, etc :- The flesh, hide and bones (a) of every animal slaughtered under rule 8, or (b) seized and removed under rule 11, shall be destroyed and disposed of by the supervisor in such place and manner as the Deputy Commissioner may direct: Provided that if the disease from which the animal is declared to be suffering be not anthrax, black- quarter hemorrhagic septicemia or rinderpest, hide only may be returned to the owner. 13. Registers :- The supervisor shall maintain a register in such form as may be prescribed by the Deputy Commissioner showing the animals. (i) examined under rule 4; (ii) rejected under rules 6 and 9; (iii) detained under rule 7; (iv) slaughtered under rule 8; and (v) passed for slaughter. 14. Slaughter-house occupiers and licenses :- (1) Every occupier other than the holder of a license for a slaughter house shall apply to the Deputy Commissioner for a license. (2)The Deputy Commissioner may, for reasons to Be recorded or suspend in writing, refuse to grant a license, or may cancel a license. (3) The license shall be in Form B; and shall be issued on payment of a fee of Re. 0-8-0-. 15. xxx :- If any licenses be convicted of an offence under section 5 or section 7 of the Act, the Deputy Commissioner shall cause such conviction to be endorsed on his license. 16. Attention of animals for slaughter :- (1) All animals passed for slaughter except sheep and goats shall be kept in a place appointed for a period of not less than 24 hours before slaughter. (2) Every animal brought into the slaughter house shall, until it is slaughtered receive from the license of the slaughter house a daily food ration according to a scale to be fixed from time to time by the Deputy Commissioner for each class of animal and as much water as it required. Explanation. An animal shall be deemed to require whatever water the supervisor may order from time to time. (3) If the licensee neglects to feed or water any animal in the manner prescribed by sub-rule (2) the supervisor shall himself feed and water such animal and shall recover from the licensee the cost of so doing according to a scale to be fixed from time to time by the Deputy Commissioner. The licensee may also be prosecuted under section 5, clause (b), of the Act. 17. Explanation. Slaughtering :- (1) No animal shall be slaughtered or rendered unconscious in such a place or position that it is seen by another living animal or can itself see another dead or unconscious animal. (2) No animal shall pinioned or blindfolded for more than five minutes before slaughter. (3) The method of slaughtering shall be as nearly instantaneous as i s consistent with the recognized religious usage of the person employed in the slaughter. 18. Maximum daily number of animals to be slaughtered :- The Deputy Commissioner shall fix the maximum daily number of animals of each class which may be slaughtered in each slaughter house in his district. RULES UNDER THE SLAUGHTER OF ANIMALS ACT. 19. Employees registration :- The licensee of a slaughter house shall maintain a register of all persons employed therein. 20. Exclusion of suffers from infectious diseases :- No person suffering from leprosy sores, or any disease of the skin or any contagious or infectious disease, shall enter or be allowed to enter a slaughterhouse or any part of the promises of any stockyard appertaining thereto. 21. Dogs :- No dogs shall be admitted into a slaughter house of any stockyard appertaining thereto. 22. Control by Deputy Commissioner Sanitation :- (1) The Deputy Commissioner may, at any time, issue instructions in writing consistent with these rules for the maintenance and general management of any slaughter house in his district, and all occupiers of, or persons employed in, such slaughter house shall be bound to obey them. (2) In particular the Deputy Commissioner may issue regulations and orders- (a) sending apart places for the slaughter of animals, or for the manufacture of jerked meat or for the preparation of hides, bones or any other products of slaughtered animal; (b) for the cleansing and repairs of the slaughter house and for the removal of destruction of all offer and refuse; (c) for the maintenance of a sanitary staff; (d) generally for maintaining the slaughter house in a sanitary condition. 23. Inspectors :- Any Inspector appointed under section 3, sub-section (1), of the Act, may, when inspection a slaughter house within the local limits for which he is appointed pass such order in writing as he may consider necessary for the proper observation of these rules, or of any instructions issued by the Deputy Commissioner under rule 22, and all occupiers of, or persons employed in, that slaughter house shall be bound to obey such order: Provided that an appeal shall lie to the authority to whom such Inspector has been declared to be subordinate by notification under section 3, sub-section (3), if the Act, within 15 days from the date of the order complained of. 24. Cost of Supervision :- T h e expenditure incurred by the Government in maintaining necessary staff for supervision shall be paid by the licenses of the slaughter house at such time and in such manner as the Deputy Commissioner may from time to time direct. 25. Appeals :- No appeal shall lie against any order passed under the above rules, except as therein provided for and in no case shall a second appeal be allowed. SCHEDULE 1 FORM A License. This license is granted in accordance with the rules ---------------- framed under the Central Provinces Slaughter of Animals Act to -------------- to establish a slaughter house (for --------------------_ in the --------------- maintain----------------- area specified and on the plan already approved by the Deputy Commissioner. Area The license shall be subject also to the following conditions:- 1. Maximum daily slaughter of head. 2. Any alteration in place shall receive approval of the Deputy Commissioner. 3. Licensee shall be bound to maintain the slaughter-house in a sanitary condition. 4. Licensee shall observe all conditions laid down in the rules or regulations issued by the Deputy Commissioner under rules 22 or orders passed by an Inspector under rule 23. 5. The licensee shall pay quarterly in advance the cost supervision as required by rule 24. 6. In addition to any other penalties provided by the law, the Deputy Commissioner may cancel or suspend this licensee with out notice for breach of any condition of the license. Note:- This license is liable to cancellation without further notice for breach of any of the rules made under the Control Provinces Slaughter of Animals Act or of any order passed by the Deputy Commissioner of an Inspector under these rules.
