Interpretation CENTRAL RESERVE POLICE FORCE (MEDICAL CADRE) RULES, 1996 G.S.R. 392 dated 20th September, 1996. In exercise of the powers conferred by Sec. 18 of the Central Reserve Police Force Act, 1949 (66 of 1949), and in supersession of the Central Reserve Police Force (Medical Officers Cadre) Rules, 1976, except as respects, things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely: 1. Short title and commencement :- (1) These rules may be called the Central Reserve Police Force (Medical Officers Cadre) Rules, 1996. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions :- In these rules, unless the context otherwise requires: (a) "Cadre" means the Medical Officers Cadre (Group A) Cadre constituted under rule-3; (b) "Government" means the Government of India; (c) "Grade" means a grade of the cadre; (d) "Schedule Castes" and "Scheduled Tribes" shall have the same meanings as assigned to them respectively in clauses (24) and (25) of Article 360 of the Constitution; (e) "Table" means the table specified in sub-rule (2) of rule-3; (f) the words and expression used herein but have not defined shall have the same meanings assigned to them in Central Reserve Police Force Act, 1949 and Central Reserve Police Force Rules, 1955. 3. Constitution of the Cadre :- (1) There shall be constituted a Medical Officers' Cadre in the Central Reserve Police Force and it shall consist of the categories of posts specified in columns (2) of the Table below. (3) An Officer appointed to the cadre shall be given over and above pay admissible in the relevant scale, post graduate allowance of Rs. 100 per month or Rs. 200 per month as the case may be, for possessing recognised Post Graduate diploma(s) or Post Graduate Degree(s) respectively, specified under the Indian Medical Council Act, 1956 (102 of 1956). The maximum allowance shall be payable only at the rate of Rs. 200 per month to an officer who possesses both recognised post graduate diploma(s) and post graduate degree(s). 4. Authorised strength of the Cadre :- (1) The Cadre shall consist of one post of Director (Medical) and 312 floating/commn posts in the grades of Medical Officer, Senior Medical Officer and Chief Medical Officer. (2) After the Commencement of these rules, the authorised strength of the duty posts in various grades of the cadre shall be such as may, from time to time, be determined by the Government. (3) The Government may include in the cadre any posts other than those included in Table specified in (1) of rule-3 or exclude from the cadre a post included in the said Table. 5. Recruitment to the Cadre :- (1) The posts of Medical Officer shall be filled up by direct recruitment, failing which, by transfer on deputation or transfer of suitable persons holding equivalent or analogous posts under the Central or State Governments or Public Sector Undertakings or Autonomous bodies, or transfer on deputation or re-employment of Medical Officers of Army Medical Corps, possessing the qualifications prescribed for direct recruits. (2) The posts of Senior Medical Officer shall be filled up by promotion of Medical Officers with four years regular service in the grade on the basis of seniority-cum-fitness without linkage to vacancies. (3) The posts of Chief Medical Officer (Ordinary Grade) shall be filled up by promotion of Senior Medical Officers with six years regular service in the grade or ten years of total regular service in the cadre on the basis of seniority-cum-fitness without linkage to vacancies. (4) Chief Medical Officers (Ordinary Grade), who have rendered not less than six years regular service in the grade shall be eligible to be appointed as Chief Medical Officers (Section Grade) on the basis of their fitness to hold the said post. (5) The post of Director (Medical) shall be filled up by promotion from amongst the Chief Medical Officers (Selection Grade) with not less than three years regular service in the grade or seventeen years total regular service in the cadre on the basis of merit with due regard to seniority. 6. Initial constitution of the Cadre :- (1) All the officers holding Group-A post immediately before the commencement of these rules on the regular basis in the Medical Officers Cadre constituted under the Central Reserve Police Force Medical Officers Cadre; Rules, 1975 as amended from time to time shall be members of the cadre in the post of grades as the case may be. at the initial constitution stage of the cadre. 7. Age limit,qualifications, etc. for appointment to the grade of Medical Officers in the cadre :- 8. Composition-of Selection Committee and Departmental Promotion Committees :- 9. Probation :- (1) Every person appointed to the cadre in the grade of Medical Officer by direct recruitment and re-employment shall be on probation for a period of two years. (3) At any time during, or at the end of the period of probation or the extended period of probation, the Central Government may discharge a person appointed on probation, without assigning any reasons, whatsoever. 10. Liability to service :- Any person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad. 11. Private Practice :- No person appointed to any posts under these rules shall be permitted private practice including consultancy and laboratory practice. 12. Superannuation :- The retirement of a person holding a post in the cadre shall take effect from the afternoon of the last day of the month in which such person attains the age of 58 years. In case the date of birth falls on the First day of a month, the retirement of such a person shall take effect from the afternoon of the last day of the month preceding the month in which such person attains the age of 58 years. 13. Seniority :- The inter-se-seniority of officers appointed to posts in different categories/grades of the cadre shall be determined in accordance with the general orders issued on the subject by the Central Government from time to time. 14. Combatised ranks for officers in the cadre for the purpose of discipline, command and control :- The officers appointed to the cadre in any grade shall put on the ranks/badges of ranks as under; 15. Disqualifications :- No person, (a) Who has entered into or contracted a marriage with a person having a spouse living, or (b) Who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the cadre : Provided that the Government may, if satisfied that such marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 16. Other conditions of service :- The officers appointed to the Cadre shall be subject to the Central Reserve Police Force Act, 1949 and Central Reserve Police Force Rules, 1955 in respect of other conditions of service not specifically provided for in these rules. 17. Benefit of added years of service :- Benefit of added years of service under Rule 30 of CCS (Pension) Rules, 1972 as amended from time to time shall be available to all the members of Medical Officers of the cadre. 18. Power to relax :- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules in respect of any class or category of persons. 19. Saving :- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided tor the Scheduled Castes, Scheduled Tribes, other Backward Classes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Government from time to time. 20. Interpretation :- If any question relating to the interpretation of these rules arises, it shall be decided by the Government.
