S.O.444 (E), dated 13th July, 1978.-In exercise of the powers conferred by Sec. 3 of the Essential Commodities Act, 1955 (10 of 1955) and in supersession of the Copper (Prohibition of Use in the Manufacture of Electrical Cables and Wires) Order, 1970 the Central Government hereby makes the following Order namely: 1. Short title, extent and commencement :- (1) This Order may be called the Copper (Prohibition of Use in the Manufacture of PVC and VIR Wires of Domestic Type) Order, 1978. (2) It extends to the whole of India. (3) It shall come into force at once. 2. Definitions :- In this Order- (a) "Copper" means electrolytic copper specified in specification No. IS: 613 of 1964; 1[(b) "PVC and VIR wires of domestic type" means the following cables having nominal cross sectional area of conductors upto and including 16mm 2 2 namely: (i) 250/440 Volts grade rubber insulated cables as per tables 25,27,31 and only TRS cables in table 29 of IS: 434 (Part-I)-1964; (ii) 650/1100 Volts grade rubber insulated cables as per table 26 and only TRS cables of table 30 of IS: 434 (Part-I)-1964; and (iii) PVC insulated cables as per table 1 and table 3 of IS : 694- 1977]. (c) "Manufacturer" means any person who is engaged in the manufacture of PVC and VIR wires of domestic type by any process whatsoever. 1. Prohibition of use of copper in the manufacture of PVC and VIR wires of domestic type :- (1) No manufacturer shall use or cause to be used copper in the manufacture of PVC and VIR wires of domestic type except with the prior permission of the Central Government. (2) Nothing contained in sub-clause (1) shall apply to the use of copper- [ (a) in the manufacture of PVC and VIR wires of domestic type by undertakings having investments not exceeding twenty lakhs of rupees in plant and machinery for such manufacture; or] (b) in the manufacture of PVC and VIR wires for the purpose of export which are covered by firm orders and backed by such payment terms as are, for the time being, allowed by the Reserve Bank of India. 4. Power to enter and search for seizure, etc :- Any police officer not below the rank of Assistant Sub-Inspector or any other officer of an equivalent rank authorised in this behalf, with a view to securing compliance with this order or satisfying himself that this order has been complied with, may with such assistance, if any, as he thinks fit- (a) enter upon and search any premises, any vehicle or vessel in which such officer has reason to believe that any of the provisions of this order has been, is being, or is about to be contravened. (b) seize copper in respect of which he has reason to believe that any of the provisions of this order has been, is being, or is about to be contravened. (2) The provisions of S.100 Code Of Criminal Procedure, 1973 shall, as far as may be, apply to searches and seizures under this clause.
